City of Georgetown and Lower Colorado River Authority officials will meet in Travis County District Court on July 24 for the first hearing of a lawsuit filed by LCRA.

The LCRA filed the petition July 18 in response to a breach of contract notice issued to LCRA on June 28 by seven utilities, including the City of Georgetown, Fayette Electric Cooperative Inc., Central Texas Electric Cooperative, the City of Seguin, Kerrville Public Utility Board, the City of Boerne and San Bernard Electric Cooperative Inc.

According to an LCRA news release, the suit asks a judge to review the contracts and  determine whether LCRA continues to adhere to the terms. The suit also seeks a temporary restraining order to keep the seven utility customers from ending the contracts until the court rules on breach of contract issue.

“We would like to see this resolved out of court, but understand that a legal route may be required,” Assistant City Manager Jim Briggs said in a statement. “To this point, LCRA has refused to negotiate, mitigate, or cure this breach. We are confident that our position will be rightfully heard and a ruling returning fairness to our retail customers will evolve.”

The hearing is scheduled for 10 a.m. in District 53 Judge Scott Jenkins’ courtroom in the Travis County Courthouse, located at 1000 Guadalupe St. on the fourth floor.

“The City of Georgetown stands by its claim and will look to the courts for progress that we have not seen after repeated attempts to engage LCRA on this issue,” Briggs said.
